First of all, I am supper conceited and cheerful when I seen you return home; you are welcome, although I have been belatedly to saying.

I previously heard your agony under Sudan military or Arab people all along, as you had been subjecting as sex-suppliers, distributed to all household of soldiers during the war, you have been raped like dog or forced to sexual, no love there that results to others girls to have fatherless children due to that oppressive, but you surmount the situation, thank God, you have got freedom and those children are yours forever and ever, don’t worry, feels at home, no more pains.

However, Returnees, you are so cute, pretty and beautiful, no man can refuse you, you deserve hundred herds of cattle {nyanbout} with your multi-colours, no doubt but shortly Sisters, you ensue to be “Masura” {futile} song by Silver X, Country Artist, which infuriate me {we}, you have turned to be mobile, wireless internet,  laptop, cigarette, distributors and helpers in Juba and East Africa Countries, as cheaper one, money-lover by spent night with all men, why do you do that? What force you? While you have almost five men running after you, fighting on you and you starting selling your body, what do you mean? I know is not my business but I saying because I see future on you.

Obviously, I {we} know that, you had been in impound freedom in Khartoum, or elsewhere part of South towns occupy by Sudan Military during the civil war since your birth time, no night clubs to killed time, no bars hotel to enjoy yourself, just sandwich plus soda, as freedom are being Arabicization and Islamicization, leisure had been curbed by shaira law, due to that inert freedom of enjoyment of no Bars and lodges in Khartoum {for the unmarried to lease to have sexual}, has kept your sexual reaction into rest while you hunger for delight.

Then, after you got this white freedom in South Sudan and East Africa’s Countries, you misuse yourself, took leads, being in tough marathon to overrun experts girls, like in Juba, you are always at Juba bridge Hotels and  bars, Home and Away,  Kush Resort, Green Rokon, Intra-Africa, Oasis and Bros Hotel, also in Kampala and Kenya, where you declared war on beers and sexual, I know is it enjoyment but is too much than expectation, drinking more than ten bottles of beers, is suicide until you lay flat, then anon you signed MOU with homeless man with cheap price, even having sexual without sock, then tomorrow, you will give it to your con boyfriend,  are you faithfully really?, what kind of stupidity phony is that?, is there any guarantee for  the two sex  not to caught diseases, I don’t think.

Not that, in Kampala, you are well known as  wild-cat, shisha and weed smoker, gold-digger, prostitutes or commercial sex instance for studying,  also prisoner in the Uganda prison due to {your} criminal act, what the hell are you doing?

Why do you share yourself? Be faithful to one person, though he is poor, hope one day he will meet your demand, but if you make yourself to be cigarette, everyone will smoke you, afterward, they will abundant you on streets and bars, as useless girl, just to supplicate person to pay sexual because you would be ineffective, people will start run away from you, no hand shaking, if people start fear you, how do you feel? who are you in future?.

Premature love and money love are not real love; don’t think that, a man who deposited you almighty dollars and pounds, love you, just did it to dig you, to fuck out his money, embarrassing you, watch out girl and think big, though life in Juba and Kampala is hard, don’t let life destroy your beautiful and dignity but I don’t see that, hardship of life in Juba, Kenya and Kampala has forced you to be gold-digger, because you came from royal family, but you have been yearning for enjoyment since then, that make you to be supplier, wireless internet to both citizen and foreign men, isn’t privation of life,  but take care, if not, you will appear on YouTube soon and you will end up like someone chasing the wind, don’t chase gratification, it will come alone.

To achieve that ultimate pleasure dear, go with your boyfriend elsewhere, { club or bar} drinking, dancing and sharing love together, do whatever you want to do with him, because he will not reveals secret to anyone, but if you just go with any man every weekend, believe that you are important girl, always walking majestically on public eyes, like churches, schools, streets, traditional dancing and wedding place, think that your private-covert are safe {you} is/are a idiot and fool.

Obama or Romney: Africa’s choice between the devil and the deep blue sea!

The upcoming US presidential election will be a de facto international presidential election. Whoever wins will not only become – symbolically and in reality – the chairman of the five-member central committee of the world, which is the UN Security Council,  he will also indirectly be in charge of the preeminent global currency, which is the dollar. Crucially, the US president will be the Commander-in-Chief of the supreme army, the nuclear-armed North Atlantic Treaty Organization (NATO). Under Article 5, “The parties agree that an armed attack against one or more of them in Europe or North America shall be considered an attack against them all.” This explains why Syria can only watch, helplessly, as Turkey, a NATO member, closes its air space, trains, arms and sends rebels into Syria.

Moreover, NATO is not only expanding although its main adversary the Union of Soviet Socialist Republics (USSR) collapsed in 1991 it is also freely choosing and picking which opposition groups are terrorist organizations or pro-democracy fighters, and which country is to be invaded on the spurious excuse of pre-emptive humanitarian intervention to maintain international peace and security.

These realities will present African peoples at home and in the US with a particular dilemma. By instinct, we should vote for Barack Obama.  After all, he is “one of us”, his father having been a black Kenyan!

The ‘one of us’ syndrome based on our ethnicity, tribe and clan is central in the African DNA makeup, which invariably determines how we provide public services to our own.

But as Obama’s African policy has shown in the last four years, it will be a monumental self-delusion for any African at home and in the US to believe that his second term in the White House will bring better news to the continent.

The uncomfortable truth is that the difference between Barack Obama and Mitt Romney is only skin deep. Like Romney, Obama is first and last an ambitious US politician, who wants to be president of the last super power of the world.

To achieve that ultimate goal, both men are competing to appear a better US citizen than the other, declaring their uncompromising commitment to pursue not the 1832 Monroe doctrine, but the 1961 President John Kennedy’s doctrine.

The Monroe Doctrine noted that the United States “would neither interfere with existing European colonies (in Africa and elsewhere) nor meddle in the internal concerns of European countries.” That was before John F. Kennedy arrived.

By contrast, in his in January 1961 inauguration speech, Kennedy said “let every nation know, whether it wishes us well or ill, that we shall pay any price, bear any burden, meet any hardship, support any friend, oppose any foe, in order to assure the survival and the success of our liberty.” By “our success”  Kennedy meant US imperial domination of the world!

Regardless of Obama’s campaign rhetoric, his Africa policy will not be guided by any consideration about is late father’s tribal origin or religion, but by US special interest to maintain political, economic and military dominance of the world.

President Obama or Romney will without hesitation use the USAID to maintain soft control over the continent through politically-motivated humanitarian and development assistance. At the same time, the United States Africa Command (AFRICOM) will keep a close military eye and ear on Africa from the ground, air, sea and space. Any African leader or military commander who thinks his or her official and personal secrets are safe is a fool.

President Obama or Romney will use the Bretton Woods institutions, which are the World Bank and the International Monetary Fund (IMF) to manipulate African economies and by extension, social and political conditions, which suits the US.
Whoever wins, the World Trade Organisation (WTO) will not relax the pressure on African countries to introduce legislation to implement the one-way Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). These, among other things, will potentially allow western technology companies to “own” anything and everything including trees and shrubs anywhere.

The US, which has not ratified the Rome Statue, will continue to selectively use the ICC as a double-edged political weapon not only to punish non-compliant African leaders such as Omar al Bashir and Robert Mugabe, but also to protect leaders of US client states who torture their own people and invade their neighbours.

While some US companies continue to trade with Iran, President Obama or Romney will demand and get the UN Security Council to impose punitive sanctions on any African country that buys oil from Iran.

NATO intervention in Libya may have been its first on African soil, but it is unlikely to be the last whoever wins. Neither Obama nor Romney will lift the sanctions on Eritrea, Sudan or Zimbabwe.

US entry visas will not become any more easily available for African students or old people wishing to visit their grandchildren just because Obama or Romney has become president.

Finally, according to the Census Bureau, 15 percent of Americans, or more than 46 million people, live below the poverty line, defined as an annual income of USD 23,000 for a family with two children.

The vast majority in this group are African-Americans. They will not become better off with well-paid jobs, adequate housing and health-care cover when and if Obama or Romney takes office next January. That is why I say Africa’s unpalatable choice in the 2012 US presidential election is between the devil and the deep blue sea. We are damned if “one of us” Obama, wins and we are damned if he loses on November 6th!
But why criticize Obama for putting America first and last?  What a different place would Africa be if our leaders could also put behind their personal interests, clan, tribe and ethnicity – and tackle the population explosion and youth unemployment, which are driving millions of young men and women to die abroad?

The office of Twic East Community denounced the act of interest group who had announced that there will be “Twic East Community Mega-Conference in the United States will be held in Omaha, Nebraska on November 10, 2012.” Which was authorized by the following people, namely: David Kuol Anyieth, Gabriel Paker Ajang, Peter Magai Bul, and then posted on: www.newsudanvision.com. To Twic citizens, you all need to be aware that, it is totally unrecognized group meeting who are trying to hijack, scam or forge  the name of the really Twic East Community of South Sudan-USA which had been registered as a Non-Profit Organization. According to our knowledge of non-profit organization rules, these people are playing against the bylaws. So to you all Dinka Twi citizens, if you believe in Twic independency and freedom and  not pro-Dinka Bor or Greater Bor ideology of Borism and Borization in expenses of our ancestors’ identity so that announced meeting is not for you it’s for those who deny their own identity (Twic) thinking we cannot survive on our own as people and county .

We think it is better for you not to smear your own image within your ancestor tribe of Dinka Twi by joining that event; it is our brotherly and sisterly advice. In addition to that, these people are playing against South Sudan constitution which stated, “The Transitional Constitution of South Sudan, 2011 article 33 stipulates the Rights of Ethnic and Cultural Communities citing that ‘Ethnic and cultural communities shall have the right to freely enjoy and develop their particular cultures. Members of such communities shall have the right to practice their beliefs, use their languages, observe their religions and raise their children within the context of their respective cultures and customs in accordance with the Constitution and the Law.” The reason why we have mentioned the above South Sudanese Transitional Constitution is to let you know that as a loyal citizen of Dinka Twic, nothing will take away our ancestors’ identity because our people right is being protected, and at the same time, we are on right side of Dinka tribe factual history.

If you believe in our county Twic East county independency, we advise you not to join Omaha meeting,  because it’s organize by people who are been known for undermining  our Twic Dinka people identity, projects and activities. We have statements and records of them refusing formation of Twic community in USA and favoring Dinka Bor or Greater Bor name that is not based on a factual and truthful of these tribes’ differences when it comes to Dinka tribe history. The only thing they have on their side is lying and bias attempts purposely to destroy the Twic East Community for the sake of their own interests. In other hand too, it’s a fact that they are being employed through that ideology. By attending Omaha meeting or organization affairs, you have to bear in mind that, as an office of Twic East Community of South Sudan-USA, you’re supporting an illegal events according to non-profit organization where there’s an attempt to collect funds illegally under the name of registered and existing organization because they will be held accountable for their wrong doing for failing to present legal documentation.  It will be your own decision or idea if you decided to attend that event. Also, we are going to monitor whoever will attain the unrecognized meeting as office for our people future records keepings or references. Thus, there is no chance to anybody who is trying to impose an unidentified identity to our people. As old says from dog, “please don’t scare people with sharp object” so do we have to say to our brothers and sisters who are trying  these kinds of unethical themes, undignified and un-integrity behavior that is not always coincided with truth align argument. Right now we are surprise within our community because based on our people backgrounds, truth is always matter. At the moment, we percept as an alien behavior that is not Dinka Twi people ancestors’ values or characters have before, period.

According to our record, we advice some of the following people who are attempting to play danger game against the Bylaws of the Non-Profit organization under the name: Twic East Community of South Sudan-USA. Brothers and sisters read this message to understand what it says, ““Articles of Incorporation vs. Bylaws: The articles of incorporation essentially make up the constitution of the organization. There are specific items that have to be included in the articles of incorporation in order for the organization to receive tax-exempt status. One of the requirements is a “statement of purpose and statements indicating that the organization will not engage in prohibited political and legislative activity and that all of its assets will be dedicated to its exempt purpose under 501(c)(3).”Bylaws explain how the organization will be run on a daily basis, and by whom. Think of the bylaws as the job description of the president, the board of directors, and of the organization itself. Unlike the articles of incorporation, the bylaws do not have to be filed with the state, but they can be. A current record of the bylaws does have to be kept within the company.””
You Twic East county citizens have also to know that, we don’t accuse them for what we don’t truly know but it’s a legitimate reason. Most of these peoples are having records whereby they have either worked directly or indirectly or being spied within our community for the benefits of their new adopted name so-called Dinka Bor or Greater Bor. They use this name “Bor” as a cover-up to destroy our ancestors’ identity that we might all know the Dinka Twi. For example: Gabriel Pager Ajang is a well-known that he is part of Greater Bor group under the leadership of Abraham Deng Lueth,  and he before opposed formation of current Twic office in Nebraska, Peter Magai Bul in 2010 did work as part of campaign of leadership for the Greater Bor group in 2010. And recently they were joined by Bul Thuc Dut and Deng Chol Yuang, in illegal endorsement of David Kuol Anyieth.

Back to the Greater Bor election of 2010 in Grand Rapids, MI-USA, Abraham Deng Lueth, Mabeny Kuot, Gabriel Pager Ajang, Peter Magai Bul plus others did deviate (“stray from normal path) the leadership of Twic East Community of South Sudan-USA whereby they were advised not to join the Greater Bor Organization election because there were some issues were needed to be addressed first, but they didn’t listen to the office leadership to abstain, and that time most of the community members were refusing to join the Greater Bor election even when they were present at venue. Twi Citizens, we are not smearing them for what is not true. We are following the fact base story here.

Also, you citizens of Dinka Twi might have to know that; these peoples who are pro-Bor Dinka or Greater Bor over the Dinka Twic people identity and all principles or values we stand for as one people. Their stories might have some factors that are affecting our brother David Kuol Anyieth when it comes to the leadership handover to him plus other reasons did occur during the transition period we are not going to talk about here though. As our concern as office, we sense that David Kuol Anyieth association with pro-Bor Dinka or Greater Bor group. The majority of our people don’t trust those who associate themselves with such unrecognized entity. Furthermore, the Payams leaders in USA, we know who they are, and their connections with the group. We are not going to talk about that right now.

 

Moreover, we are informing you all our Dinka Twic citizens that if you know yourself to have an ability to lead our people. Chance could be yours, as we the office expect an election on July 2013. Otherwise thing might change as future always uncertain, particularly; it could be date, but we still believe that the office would be changed next year. So please prepare yourself before time, and also you have to bear in mind that; the Twi Dinka community needs a person who always will stand first for everything we are made as a community. Starting with our name, history, culture, Dialect, values, and so forth, because this time is for a person who will take his/her talents to our people ahead of everything else outside our Dinka Twic tribe constituency. Also, we believe that everything outside our community should be a secondary asset. Furthermore, it is time the Twic citizens have to nurturing their remaining orphans of the civil war. As we all know what the civil war of the Sudan had done to our people, even many lineages within Dinka Twi are having nobody to continue the chain of the family. From Excitement to Heartbreak.

I am worried man, my country men, women and youth worried because the country ruling has turned into erroneous way and looting manners, also the country politicians and day today leaders are not longer carry about its citizens.

The citizens degree on government/political are eroded dramatically, simple citizens are hopeless, no dreams of change in their eyes, which they expecting from the government because leaders run after money and his/herself satisfy, not development or even carry about citizens life.

In fact, when the process of comprehensive peace Agreement {CPA} began in Kenya early in 2002, the citizens in both refugee camp and displaced areas, were in position of happiness, as they optimism “storm is over”, with theme, “time for peace, war is over”, though I didn’t do opinion survey, I heard people were thirsty for peace, no doubt about that,  also they were given opportunity to commenced on the accord, as former SPLM/A leader endorse consultation to everyone who know how to read and write, thousands of citizens posted their view through internet exception of those who have no access to the internet like me but wasn’t matter, our sight has been done by those brothers and sisters, which resulted to final signing of CPA ,2005, stopped bloodshed, no more bleeding and weeping, bring hope to the citizens, they are going to be citizens of indiscrimination country, they are not longer be called monkey, charcoal  {makaa} and beggars.

On final day of CPA, civilians and students native of the South Sudan all over in the World, Diasporas,  South displaced areas, refugee in Kenya and Uganda and more other countries make it to Nyanyo stadium on their own transportation, carrying flag and slogan,  with great joys, singing and dancing as happiness engulf them, just to bystander the peace, Nairobi has became capital of South Sudan, even Kenyan were South Sudanese on that day, they provided free public vehicles to many southerners resident in capital, thank to Kenyan for their unwavering support.

The citizens also show the same things in 2010 general election, matching to 2011 referendum, which citizens voted overwhelming in supported separation, some voted twice and even more while he/she was footing for three hours, no vehicle to transport him/her to poll station, no doubt, they did it with all their heart because they want to be free, to be decision making, hopping their children will go to school without discrimination again, but things fall apart after they won the game.

While the civilians fought with Arab through voting, as citizens accomplished their war victory, that rebirth to Republic of South Sudan,” some government officials {traitor} get opportunity to diverted and looting population funds into their own self-build, instance for development to rewarded civilians hand done, citizens got nothings on the ground, no roads, no schools for their children and no health centers, people died like a dog and insecurity has intensified again, their properties are raiding by armed youth, {whether they are armed by our traitors in juba or Khartoum to destabilized the country},  which threatened the civilians to surrender cultivation, while the government pay deaf-ear on the situation, this stipulation frustrated theme, they became desperate and disappointed, resulted to person self-talks on street, is this country I voted for it? Abusive the government because the “feeling of political efficacy are generally low”, as resulted some people run mad or physiological disturbed, cycling street of Juba for 27 hours, but these was  not their punishment from God, but government-made, who failed to protect their life.

Did storm is over after independent? For sure No, simple our leaders’ values money as important thing, ignoring the country citizens, who voted in general election and referendum, did money voted last time?, I don’t think, no good governance on the ground, just tribalism and nepotism deepen the nation, whereby jobs are gave to whom you know, not qualification so far, leave thousand of degree holder on the country street, and also no clean water and good public school on grassroots, everything developed to privatization, where will the children of poor and vulnerable civilians be? Don’t have shares in this country or their parents didn’t participate during the war.

All along, civilians excitement turned to heartbreak, as the head of state, ministers, member of parliament and country politicians are slow, sluggish and perhaps unwilling fully embrace fill implementation of hard country reform, but they just do it for self-developed, they forgot citizens, in all, they don’t considered normal people, sorry!

This draw everyone attention to ask question, did traitor or Nyagat {fifth columnist} baron vacate the field, to me the answer is big No, because when you look critically, the former and current ministers in the first and second cabinet {both national and states} influential consisted of key figure in the foe Khartoum regime or militias, who are backed by Sudan government to interrupted and weak the SPLM/A during the two decades of civil war even toward the referendum time, such people are criminal and betrayers, they just know to destabilized the Country and looting property, no development on their lip, faces and eyes, are there by picture and to eat, money-lover, shame on them, if I was president, those traitors can’t be my government {parliament, cabinet and military} because they are devil/sins, they are already cursed by God due to thousands of innocent civilians they killed, they will not do something good in their life, how can the killer rule?

With no doubt, the bungled of 2012 cooperation agreement that disfigured our face, right, freedom and values have be enhanced save injustice, inequality and corruption, that can’t just go away. Of course if the government carry about its citizens, then government would have informed the civilians along the borders and whole about the agreement, and also they can sensitize civil population, but because the government know only person who is in government, and forget the normal persons, that why they did it without consultation.

Though, the government always see hundred thousand of citizens gathered during the national event, carry flag and slogan, saying “oyee”, doesn’t means the citizens are cheerful or behind the government, but the citizens did it to protect the integrity of the Country from the worldwide, Country whose his/her beloved  husband, wife, brothers, sisters and uncles has died. nothing has been done by the government to be celebrating.

In conclusion, surely my fellow suffering citizens, yet South Sudan is going to witness a leader, politicians and Mediators with wit courage gusto and bragavado that politics will displayed in defense of his/her citizens/nationals.

I read your press release in which you’re calling for immediate release of your chairman, Peter Tut Hoth and SPLA Major General Simon Gatwec Dual who got detained by the alleged Dinka security agents recently. In the press release, you also urge every Nuer in the government to resign from Salva Kiir’s government. That is interesting! You even ‘de-nuered’ the SPLA Chief of General Staff, James Hoth Mai for having not supported your ‘cause’. He must be thinking himself to death now, trying to figure out which tribe to relocate to.  And whether there is any tribe willing to welcome him. Oh poor Mai!

Anyway,

What is Nuer Youth Executive?

Is it a political party?

Or is it a civil society organization?

What are its goals?

When was it formed?

Does the government recognize it?

What does it intend to achieve in the next 2 years, 3 years, 5 years or 10 years?

Where is it headquartered? –  Its physical address?

Who funds your projects?

There is something I don’t understand here. Your chairman was detained by the government, the very government a Nuer son is the second most powerful man. Besides, hundreds of Nuer sons are holding strategic positions in the government. So, what makes you think that the Dinka, the whole tribe of about 4 million people, is behind the arrest of Tut? If the Dinka government was picking on Nuer youth at random, why didn’t the military intelligence pick Lam Tungwar or Manasseh Mathiang or any other Nuer youth? Why Peter Tut?

I am not sure if you are aware that there is a government, a democratically elected government that is running the affairs of South Sudan, with the help of a constitution. They call it South Sudan Transitional Constitution. It contains rules and regulations that guide the activities of the government and the citizens. As a youth group of today, you cannot call for a release of an individual the government is holding over some sort of a crime. It’s illegal. If you do, others will regard you as a tribal head. And you do not respect the constitution. But you can pressure the government to speed up the judicial process: trial, hearing. And that is if you’re a registered institution. Yes, threatening the authorities to release ‘criminals’ is a guerrilla-war-era way of tackling issues of public concern, and is a bad idea at these critical times. Keep in mind that I am not saying Tut is guilty of whatever the government has accused him of, but I am just encouraging you to go it the proper channel.

Again, I am not saying you’re an illegitimate group but I am afraid, I doubt your legitimacy. If you’re a registered body of whatever kind and the government knows you, why do you tribalize the arrest of Tut to an extent of asking members of Nuer community to leave the government? Here is a secret. You are not the only youth group that does not like the way the government is managing the affairs of South Sudan. The youth have a common enemy – the ruling SPLM party which is made up of our aunts and uncles. Don’t you think it is about time every young South Sudanese ceases being a kuku, Murle or Anyuak?

Millions of youth are yearning for a change. Why can’t you join hands for a bigger, stronger and smarter body that could act as a mouthpiece for all the young people in the country?

You have a beautiful name though– Nuer Youth Executive Council!

Well, it’s all over now. No more knife fights. No more direct blows to the gut. No more memes, splendid or otherwise for another four long years. The debates are over.

My husband doesn’t share my sorrow. He’s so fed up with this political hooliganism that he refused to watch last night’s US Presidential debate on foreign policy or as I call it: Another chance for Obama and Romney to bicker about the economy, sprinkled with some international “stuff”. (“Stuff” as Joe Biden defines it.)

I don’t know about you, but these debates have been an eye-opener into the world of American politics…

The Nuer Youth Executive leadership is profoundly disturbed to inform the whole world that the Nuer Youth leader, Peter Tut Hoth, was detained at 6 am in Juba by ten armed members of SPLA Military Intelligence (MI). The reason for his detention is because he scheduled a meeting of the entire Nuer community to take place on Saturday, October 20, between 1â5pm.

On October, 19, 2012, the security agents of the government warned the leadership of Nuer Youth not to go ahead with the meeting. However, the Nuer Youth Executive leadership rejected the intimidations and decided that the meeting should take place as scheduled.
The whereabouts of Peter Tut Hoth is unknown and the entire Nuer community is concerned about his safety. He was picked up by heavily armed security agents all of them from Dinka tribe. He was pushed with the barrels of AK-47s and one agent was heard calling him Nyagat (fifth columnist). The way he was picked up is a cause for concern because our community fears that the security organs may be torturing him by now.
In 1990s, any Nuer deemed as âNyagatâ by the SPLA leadership was likely to be executed in prison. The behavior of the SPLA guerrillas has not changed with the signing of the Comprehensive Peace Agreement (CPA) and anyone detained by the SPLA is subject to torture. Besides, the fact that Peter Tut is a Nuer and the security agents who detained him are Dinka is another factor that should cause concern.
Tribal hatred is now on the rise in South Sudan because the SPLA C-in-C has endorsed a policy which targets Nuer community. The Nuer are being regarded as enemies of the state who have no constitutional rights.
Despite the arrest of the leader of Nuer Youth, the meeting took place as scheduled and was attended by all Nuer members of Parliament, ministers, civil servants and army generals including the SPLA Chief-of-General-staff, Lt. Gen. James Hoth Mai.
The Nuer community in general discussed the problem of detention of Maj. Gen. Simon Gatwec Dual, Maj. Gen. Gabriel Tang, Maj. Gen. Mabor Dhol and Brig. Gen. Gatwec Joak. The Nuer community unanimously passed the following resolutions:
1. Lt. Gen. James Hoth Mai, the SPLA Chief-of-General-staff, was dismissed from Nuer community because he violated bylaws of Nuer community which required all members to observe the rights of every Nuer such as right to life, liberty and security of the person. The Nuer general assembly found him to have participated in the assassination attempt against Maj. Gen. Gabriel Tang, Maj. Gen. Mabor Dhol and Brig. Gen. Gatwec Joak. He is also found to have endorsed the illegal detention of Maj. Gen. Simon Gatwec Dual.
Since the Nuer community bylaws required all the members to promote human values such as freedom, justice, equality and the rule of law, James Hoth violated all these principles and is seen to have turned against the values of the community. He is therefore dismissed from the community and was told that he would never participate in any communityâs activities.
2. The Nuer Youth in South Sudan were mandated to educate the Nuer in the rural areas about the governmentâs policies of discriminating the Nuer. The youth are tasked to mobilize the Nuer community to defend themselves from imminent threats of extermination.
3. The community resolved that Maj. Gen. Simon Gatwec Dual, Maj. Gen. Gabriel Tang, Maj. Gen. Mabor Dhol and Brig. Gen. Gatwec Joak should be released as soon as possible. If the Dinkaâs government failed to release them, the Nuer Youth are given the responsibility to express their disapproval for their illegal detentions through demonstrations, petitions and mobilizing Nuer chiefs.
4. The Nuer community urged all Nuer members of parliament, military officers, politicians and civil servants to resign from the government of Salva Kiir and stay in their houses. The youth advised elders that the Nuer should not take part in the government which is killing them.
5. The assembly resolved that the Nuer should form an alliance with other South Sudanese who are against oppression and injustice. The Nuer youth are mandated to work with other South Sudan youths who believe that the people of South Sudan deserve a government which respects human rights, ethnic equality and justice.

The meeting is chaired by Taban Ladu Artema, secretary general of the SPLM Minnesota Chapter. Comrade Taban started his chairing by telling Dr. Riek, welcome to Minnesota. We South Sudanese in Minnesota are very happy to have you among us. We must start our meeting by singing South Sudan national anthem.
After national anthem, Taban call up on the chairman of South Sudanese community in Rochester to say few words, the chairman states the following. I am very happy to be here, I would like to welcome all you to Rochester. I do believe that you all know Dr. Riek; he is one of the few individuals who know the history of our struggle. It is good that he has come to talk to you and you will hear directly from him. I am not going to spend much time, other than saying welcome to Minnesota Mr. vice president.
Then, Taban call upon Lero Odol the chairperson of SPLM chapter in Minnesota and Lero start his briefing by saying, “Derujiot! Male! Chuvac!” All I would like to say is that, I am very happy to be here. I am not going to have much to say other than saying thank you to Dr. Riek Machar for coming to Minnesota and take sometimes out of his busy schedule to come and speak to us. It is very important to learn from him sharing some of the very important issues facing our young nation today. The fact that a rain has rained coinciding with the coming of our vice president is a sign of blessing from God almighty. I am not going to waste time, let me just turn the microphone back to Taban so that we have enough time to hear from our guest of honor.
Taban pickup the microphone again and ask if someone has come from mayor office, there was nobody. He then call women league department, Mary Machar who was arriving the meeting hall rushed to settle down her handbag and purse and then took the stage. Mary: thank you very much brother Taban for calling upon me. I am so happy to be here! Although I haven’t prepared, I would like to thank our vice president Dr. Riek Machar for coming to meet with us. We are very fortunate to have him among us today. Dr. Riek’s father name is the same as my father name. We have something in common. The fact that I haven’t prepared, I must only ask question to our VP, here in US, many of our children are in prisons, what can our government do to help these children? Please, we need help!
In proceeding, Taban call upon pastor Andrew, like Mary said, I haven’t prepare either, but I am so happy to be here among you and I am happy to be part of Sudanese community in Rochester Minnesota. We are very blessed to have South Sudanese Christian brothers and sisters among us. In South Minnesota, we have about six different Sudanese congregations who praise God with us together every Sunday; that a huge blessings from our heavenly father. I ask God to continue that blessing and help us fulfill one another needs. And then, he prayed blessing the gathering.
After Pastor Andrew, Taban introduce Lado Gubek who said the followings, His Excellency, Dr. Riek Machar Teny, the Vice President of the Republic of South Sudan, His Excellency Dr. John Akec Koch, the ambassador of the Republic of South Sudan in Washington DC ladies and gentlemen, more than twenty years ago, Dr. John Garang and many others took up army to fight for injustices in Sudan. They fought against many regimes in Khartoum so that we inherent freedom. For more than these twenty years, we have been mistreated, oppressed, marginalized and massacred in large numbers. Last year, our suffering came to an end on July 9, 2011 when our independence was proclaimed. I must compare this as the birth of a baby and I must give this baby a mother. Let me use Rebecca Nyadeng as an example. Rebecca Nyadeng for twenty plus years had been pregnant and gives birth last year for ten children whose eleven of them hasn’t been born yet but will be born soon. These ten children are ten States of South Sudan plus Abyei that will be soon become our additional State. Through our leaders and all SPLA gallant forces, we are free at last! Now is the time to enjoy the prosperity of our land and coexist peacefully. Our guests of honored are Drs. John Akec and Riek Machar, both men are from Minnesota. John Akec was a resident of Minnesota before becoming an ambassador. Likewise, Riek Machar has family members in the State of Minnesota, therefore, they are Minnesotans. Due to the time factor, let me turn the chapter to introduce one of a friend. He was a medical Dr. before peace and became an ambassador during the interim period, ladies and gentlemen; help me in welcoming our ambassador His Excellency Dr. John Akec Koch!
John Akec: thank you very much Ladu Gubek for the nice introduction. I am very happy to be here. His Excellency Dr. Riek Machar Teny, the vice president of the Republic of South Sudan and Mrs. Becky Machar; my friend the chairperson of the SPLM chapter in Minnesota Mr. Lero Odol and all of you, I am so delighted to be home. I was in Minnesota before I became an ambassador, so this is my home. As you know that I am so euphoria and elated to be with all of you again, I am not going to speak longer. I must only express my appreciation to each and every one of you for welcoming me back to Minnesota. I will save some times to chat with many of you after the meeting. I want all of you to know, I am not the first ambassador of South Sudan to United States. The first ambassador is you-South Sudanese people who were the first to tell our American friends about the suffering of our people. I must stop here and let our guest of honor his Excellency Dr. Riek Machar Teny speak to you, ladies and gentlemen, here is our Vice President Dr. Riek Machar Teny! Applause.
Dr. Riek: Thank you very much ambassador Dr. John Akec for the nice introduction. I came early in the morning to Rochester. I had prepared. It is good to be here with you today. I will start my presentation with the present agreement between the two countries. You all know that we close down the oil last year. We thought it was a good decision. However, it turn out, many people even our good friends were not pleased with the decision we took. I must base first part of the presentation on nine points we had just agreed upon. The agreements we just signed are as followed:
1 The 1st agreement is an Agreement concerning Oil and related Economic Matters: We have agreed on financial arrangements for the transportation, transit and processing fees of South Sudan oil through Sudan. Very soon, the government of South Sudan will take necessary measures to resume oil production from all fields in the territory of South Sudan with in 14 days of the signature of the agreement. Our government will issue an instruction to the oil companies operating in South Sudan to reestablish oil production in the same token, Republic of Sudan within the same period will issue instructions to oil companies to reestablish processing and transportation facilities for oil produced from South Sudan onward to Port Sudan. A joint Petroleum Monitoring Committee shall be established within twenty 21 days of the signing of this agreement to oversee the implementations of the provisions. The agreement shall remain in force for a period of three years and six months as the date the first South Sudan oil is delivered at the marine terminal and a bill of lading issued.
2, The 2nd agreement is the Framework Agreement on the State of Nationals of the other State: This agreement essentially is an agreement on the four freedoms; these are residence, movement, undertaken economic activity and ownership of property. In South Sudan we still have Sudanese from Sudan who live and do businesses. These individuals’ life will be protected and be allowed to move freely between our two countries. A high level joint committee shall be established to oversee the adoption and implementation joint measures relating to the status and the treatment of the nationals of each State in the territory of the other state. This committee shall hold their first meeting within two weeks.
3, The 3rd agreement is an Agreement on Boundary Demarcation and border issues: Our border happens to be the longest border having 2, 000 kilometers extended from Northern Barh el Ghazal State to Southern Blue Nile near Ethiopia border. Yet, we still have not agreed on border issue; however, African Union mediators working out the differences that are remain unresolved. It has been stated that, a joint border commission will be appointed to complete the demarcation process. Their work will start very soon and their movement will be protected.
4 The 4th agreement is Framework Agreement for Cooperation on central Banking issues: Before South Sudan independent, Sudan has only one Central Bank; now, South Sudan has created its own central Bank. In this regard, a parallel banking system must have to be created. A committee will be appointed and their work will purposely be supporting financial stability and sound banking policies in the two States in order to enhance cooperation and to promote trade and mutual economic viability of the two countries.
5 the fifth is the Agreement on Trade and Trade-Related Issues: Our two countries are tied culturally. It would be impossible for us to avoid trading with each other. In this agreement, there will be a joint ministerial committee who will work specifically on establishing trade relations. They will work in promoting technical cooperation in regard of trade and trade-related issues. Their work will also involve dealing with supply and demand. They will also work to pick profitable or fair prices to each and every trader and customer who try to raise prices beyond the normal. They will also going to be faced with tough competition regard of diversification of economical commodities.
6 The sixth is the Agreement on certain economic matters: Division of Asserts and Liabilities, Arrears and claims and joint approach to the International community:
This agreement is the distribution of assets. Any asset located in the land falling on the side of the Republic of Sudan, will fall to the hand of Sudan government; and asset located in the land falling on the side of the Republic of South Sudan will fall to hand of South Sudan government. The agreement is dealing on the assets and liabilities including debt and balance of payments in support of State archives, cultural heritage property, and non oil arrears. We have agreed that, we must pay 3.8 million dollars to Sudan to help pay its international accredited debt.
7 The 7th is the agreement to facilitate payment of post-Service Benefits:
The Republic of Sudan as the continuing State has acknowledged its duty and agreed to pay all post-service benefits to all South Sudanese who were working for the government of the Sudan. A joint ministerial committee to work on pension will be established. Their responsibility will be to discuss all issues related to pension’s administration of relevance to the two States.
8 The 8th Agreement is on security Arrangements:
The parties agreed to cease harboring or supporting rebel groups against each other. In a very short period of time, the two countries’ border will be demilitarized. The parties had also agreed to open border crossing corridors immediately.
9 the Issue of Abyei
We failed to agree on the issue of Abyei. Abyei is a home of Nine Ngok Dinka but annexed to north in the time of colonial rule in Sudan. During CPA negation in Kenya, it was not easy to resolve Abyei protocol. The deadlock was brokers by Americans. I mean, Abyie agreement was arranged by the Americans and both North and South accepted it. During the interim period, the government in Khartoum fails to implement the provision of Abyei together with Southern Kordofan and Southern Blue Nile protocols. That led us to file court arbitration in Hague. Yet, Sudan did not respect the outcome, and that led us to war again in Hegleg or Panthou this year. We withdrew from area following International Community pressure. In this current agreement, Bashir has rejected the African Union High Implementation Panel (AUHIP) proposal gain under former South African president Thabo Mbeki who works to facilitate negotiations between the two countries. We are now leaving it on the hand of AUHIP to keep pushing the two countries.
Beside the above points, I have three additional points to make. Number one, while you continue to live in this country, make sure you are going to school. When you come to South Sudan, come with a degree we will employ you. A degree is not only demanded in South Sudan, it also demanded even here, when you have a good education, you get good job that pay well. If you could not able earn a degree, come with money, you will establish a business that will replace the education. Then if both education and money are hard to get, make sure you invest in your children’s education. Educate your children so that one day, they will carry on your legacy. Don’t be like some of us who migrated to North Sudan in our days in school who did not grasp the opportunities that were available to them. They lived like they will go home tomorrow; yet, some of them didn’t go anywhere they became old in the North and didn’t do anything possible for their future. Many of them end up there.
We know many of you contributed one way or the other during the war. We still expect you to do the same in the development of the country. When I was in Arizona last two weeks, I met some of you who are helping with the development. For instance, John Dau establishes a clinic in his home town. Peter also establishes a clinic and Koch establish a primary school. These are the lost boys who came here like you, finished their education and decided to do something back home. I know there are many of you who will not go back to South Sudan; if you choose to stay, make use of the American dream. This is a land of abundance where hard work is paid off. Do not engage in criminal acts; just work hard to reverse the poverty you were in? This is a land you can work hard to realize your potentials. While ago Mary Machar talks about those of you who have broken the law; I know you have about 3, 000.00 south Sudanese in jail. You ran away from the war in Sudan years back, there is no reason for you to make trouble in this country. Americans have received you with open arms. But, if you are committing crimes, then you are disappointing the Americans who are working hard to help you. You all know American people had supported our struggle. Without the help of the United States government, we might not be an independence State today. We might still be at war. Like I said many times, organize your-selves as South Sudanese community. Few minutes ago someone handed me a paper advocating for tribalism between you here, this is a good start. I know all of you are not supporting only one party in South Sudan, we have about 23 political parties, some of you may be link with those parties but, when you organize as South Sudanese, it doesn’t matter what kind of party you identify yourself with back home; you must remain member of the large South Sudanese community.
Let me asks you, how many of you came here as only ten years old? There were nobody raised, you see, this is the change. They are not here may be because what we are doing is not in their interest or they believe it is a work for old people. These people are different and they already grown, they would be twenty-three years of age by now. Why do they change like this when you those who know South Sudan still alive, what about when you gone? These people will not know what tribes they were coming from, they will only know South Sudan if you teach them. I want you to engage our children to sports. I am 6ft 2inch what can I do if I live in this country? I should play basket ball. I want you to encourage your children to play basket ball or an American football, they will make use proud back home. Do you know Guor Marial? He is a South Sudanese-American who qualified to compete in Olympic but could not run as an American because he is still carrying Green card other than American citizenship. He could not also run as South Sudanese because we still do not meet certain requirement to be member of the Olympic body. Guor Marial was only allowed to run as an independent Marathon athlete runner; he made us proud. Do the same, encourage your children to engage in sports like him so that we are proud of them. Thank you very much! I look forward to answer some of your questions.
Audience stood in applause and some of them were singing songs. The floor was open for questions. Too many questions were asked, some in Arabic and I don’t fully understand Arabic. I haven’t either recorded all questions that were asked in English, I only wrote down some of the questions that caught my interest.

• The first question was asked by Lual Omot, Dr. Riek, you talk about good stuff but those of you in the government are doing nothing. What kind of the development and services you are delivering to people? Let take Pochalla and Akobo for example, there is no development coming to that part of the country, people still drinking dirty water, no clinic in the area, there is no everything, what do you do?
• Dr. Riek respond: we in the government came up with the idea that, in the Payam level for now, we must establish healthcare centers. And in the county level, there has to be a clinic. Then in the State level, there has to be a hospital; until when we have enough fund for the development. In Pochalla, we have a healthcare center there and have a clinic in Akobo. Also while ago, you heard me talk about some of you from Diaspora who help built clinics in their home towns, you should do the something; organize yourselves as a community and start building clinics, schools and water wells. Last month, I was invited to a gathering organized by young South Sudanese in Omaha Nebraska. I didn’t come, but I sent Paul Mayom Akech minister of water and resources irrigation who did a very good job. These young men are from maiwut they decided to bring water to South Sudan, instead of taking Bore wells to their area; they took them to Western Equatoria State. This is the kind of the good job you should be doing as organized communities. I want you to establish non profit organizations, recruit Americans and come home to do whatever interesting you.
• The second question was asked by a youth chairperson whose name I failed to record: What can the government of South Sudan do for those of us who are going to school?
• Dr. Riek, the government could not afford to pay for your schooling here in States; just use the opportunity you have here.
• The third question was that, you talk about us going to school and earn a degree or make money that when we should be successful when we come back home; what about those who have experiences on what they are doing here, like if you are a janitorial job could you still be employed? Here life is not easy. People are working hard in order for them to survive, you work; take care for the kids, then, no time for study.
• Dr. Riek: I know you are working really hard in this country, but try to balance your time with your husband. If you work in the morning, let your partner work in the evening and arrange time for study. If it became a burden for you, just invest in your children’s future; make sure they are well educated so that we will take good care of you when they are grow up.
• The fourth question was asked by Akim Lado, what is the government doing in tackling the issue of corruption?
• Dr. Riek: we have established an auditoria team. All government officials are going to be audit; this would help in tackling the problem of the corruption.

POSITION OF SPLM-DC on: “The Cooperation Agreement between The Republic of the Sudan and The Republic of South Sudan”, Addis Ababa, 27 September 2012.

 A-  General

1.      The two parties specifically state that “the people of South Sudan and Sudan share a long and rich common heritage and are bound by immutable facts of geography to remain interdependent neighbours” and affirm their “determination to work in close partnership, to finalise all outstanding details remaining in relation to the Agreements they have reached, relevant to the implementation of the Agreements thus finalized”. Here eight agreements are listed and published.

2.      The outstanding issues are listed as follows:

(i)– The Issue of the disputed and claimed border areas, and this shall be negotiated by the Parties (the two countries)

(ii)– The Final Status of Abyei Area, will be handled by the AUHIP through engagement with “The AU Peace and Security Council, as well as the Parties”.

 

Stemming from the above facts, it is clear that the Parties have agreed on the

following: 

           (1)– The only outstanding issue to be negotiated by the parties is the disputed

                   and  claimed border areas.

           (2)– The issue of the Abyei Area is now left in the hands of the AUHIP.

           (3)– All the other issues have been resolved save for some details that will be  

                  finalized through joint ministerial and technical committees to be formed by 

                  the two countries. All these committees shall be formed within varying

                 number of days from signing the Agreement (for oil and security

                 arrangements) or its coming into effect after ratification by the Parliaments

                 of the two countries (for the others).


B-   Agreement on Oil and Related Economic Issues

1.      This is an elaborate agreement but most of the aspects that came in it are of technical nature and should have been agreed upon in the National Petroleum Commission before secession.  It is mind-boggling how during the entire interim period there was no formalized participation of the Government of Southern Sudan (GoSS) in the upstream and downstream oil operations (e.g. quality procedures, metering, cross border reservoirs, etc.).

2.      The financial arrangements for the transportation, transit and processing fees of South Sudan oil in the Sudan shall be as follows: US $ 9.10 per barrel for the oil produced by Petrodar, US $11.00 per barrel for the oil produced by GNPOC and a transitional financial arrangement sum of US $ 3.028 billion to be paid at a rate of US $15.00 per barrel. This means that, the Government of South Sudan shall pay per barrel: US $ 24.10 and 26.00, respectively, for the Petrodar and GNPOC oil productions; an average of about US $ 25.00 per barrel.

3.      Each Party agrees ‘to unconditionally and irrevocably cancel and forgive any claims of oil related arrears and other oil related financial claims outstanding to the other Party up to the date of this Agreement, including the claims of arrears and other financial claims filed by each Party with the African Union High Level Implementation Panel on Sudan in February 2012.’

4.      The issue of SUDAPET is postponed to be discussed within a period of two (2) months from the signature of this Agreement.

5.      The Government of South Sudan ‘shall take the necessary measures to resume the oil production from all fields in the territory of RSS, and shall within fourteen (14) days of the signature of this Agreement issue an instruction to the oil companies operating in the RSS to re-establish the oil production…’. The Government of Sudan shall within the same period issue instructions to the oil companies to re-establish processing and transportation facilities for oil produced in South Sudan.

6.      A joint ‘Petroleum Monitoring Committee shall be established within twenty-one (21) days of the signing of this Agreement’ to oversee its implementation.

7.      The agreement shall remain in force for a period of three (3) years and six (6) months as of the date when the first South Sudan oil is delivered at the marine terminal and a bill of lading issued.

 From the foregoing, it is clear that:

 (1)– This agreement admits that the Government of Southern Sudan has

        failed its duty during the whole interim period to monitor the oil

        production, exploitation and transport arrangements. This is a right

        granted to it by the CPA. 

(2)the final figure agreed upon as fees for the exportation of South Sudan

       oil through Sudan and using its facilities (US $ 25/bbl) is not much

       further from that the Government of Sudan had asked for (US $ 36/bbl)

      during the negotiations.

 (3)–  The cancellation of all ‘claims of oil related arrears and other oil related

         financial claims outstanding to the other Party’ makes nonsense of the

         much publicized Government claim that oil of South Sudan has been

         stolen by Khartoum.

 

   (4)–  The issue of SUDAPET is an intricate matter and not just a ‘detail’ to be 

          left to the joint committee.

 

C-  Agreement on the Status of Nationals of the other State and Related Matters

    This is essentially an agreement on the Four Freedoms (residence, movement,

 

undertaking economic activity and ownership of property) and a standing Joint High

Level Committee shall be established to “oversee the adoption and implementation of  

joint measures relating to the status and treatment of the nationals of each State in the

territory of the other State”. The committee shall hold its first meeting within two (2)

weeks of the entry into force of this Agreement. There is no further elaboration on the

matter.

 D-  Agreement on Border Issues

1.      The Parties shall establish a Joint Border Commission within two weeks of the ratification of this agreement to “oversee the management and demarcation of the border”.

2.      There will also be established within the same period a Joint Demarcation Committee under the Joint Border Commission to “manage and supervise the demarcation and the maintenance of the boundary pillars and beacons”. This committee will in turn establish joint technical teams composed of forty (40) persons from each State.

3.      The two States shall confirm the completion of the demarcation process through a written formal agreement a copy of which shall be deposited with the African Union Commission.

4.      The provision of protection for the demarcation teams, as well as the movement of members of border communities across the international boundary is outlined.

 This is a framework agreement short of details and there is little or nothing to be said about it.

 E-   Agreement for Cooperation on Central Banking Issues

 The Parties shall establish a Joint Central Banks Committee within thirty (30) days of the ratification of this agreement with “the principal purpose of supporting financial stability and sound banking policies in the two States in order to enhance cooperation and to promote trade and the mutual economic viability of the two States.”

  The terms of reference of the joint committee as well as the other matters related to commercial banks are technicalities which only time will tell whether or not they will be adhered to.

F-    Agreement on Trade and Trade Related Issues

 1.      The Parties agreed to establish a Joint Ministerial Committee on Trade Relations within thirty (30) days from the ratification of this Agreement which “shall have the primary responsibility for all policy on trade and trade-related matters between the two States and shall oversee and approve the programme of the work of the Joint Technical Committee on Trade Relations.”

2.      The Joint Technical Committee on Trade Relations shall be established within thirty (30) days of the establishment of the Joint Ministerial Committee on Trade Relations, to “coordinate and promote technical cooperation and the implementation of trade and trade-related issues.”

 Again, this is a framework agreement and the details of what it can achieve for the benefit of the two countries are left to the two committees.

 G-  Agreement on Certain Economic Matters

 1.      The issues dealt with are: the assets and liabilities, including external debt and balance of payments support; state archives; cultural heritage property; non-oil arrears and other claims.

2.      The Parties agreed that Sudan shall retain all external debt liabilities and external assets of the Republic of Sudan. At the same time the two Parties shall work together to “secure from international creditors a firm commitment to provide comprehensive relief of the external debt of the Republic of Sudan”.

3.      If the international creditors do not give a firm commitment as in point 2 above, the two Parties shall enter into negotiations on the apportionment of the external debt of the Republic of Sudan and its assets.

4.      Each Party agrees ‘to unconditionally and irrevocably cancel and forgive any claims of non-oil related arrears and other non-oil related financial claims outstanding to the other Party up to the date of this Agreement, including the claims of arrears and other financial claims filed by each Party with the African Union High Level Implementation Panel on Sudan in February 2012.’

5.      The Parties and the AUHIP shall seek international assistance from the international community with respect to:

(a)    contributions of monies to provide for the one third of the aggregate amount required to fill the financial gap to the Sudan resulting from the loss of oil revenue from South Sudan (amounting to US $3.028 billion);

(b)   funding to support South Sudan in carrying out programmes and projects to meet its urgent developmental challenges;

(c)    direct debt relief of Sudan’s external debt within two years; and

(d)   assistance in the lifting of all economic sanctions imposed on Sudan.

 

From the foregoing, it is to be observed that:

 (i)– The Sudan retained external debt liabilities in exchange of South Sudan

       forgoing external assets. It is obvious that external assets, including   

       embassies buildings, have monetary value far more than all the external

       debt of Sudan which was estimated at the end of December 2010 at US            

       $37.7 billion.

(ii)– Even after this concession, both parties will strive to get from the creditors

       a firm commitment to cancel Sudan’s debt. Since South Sudan was going to

       be involved in working to get debt relief, why not from the outset divide both

        the external debts and assets?

(iii)– In addition, South Sudan will help get financial support to Sudan to cover

        Its oil-revenue gap and assist in securing the lifting of economic sanctions

        imposed on Sudan since 1997. In return, Sudan will ‘help’ South Sudan to

        get funding from the international community for its developmental

        programmes; which funding it was getting already without external help.

 

  (iv)– The cancellation of all ‘claims of non-oil related arrears and other non-oil 

         related financial claims outstanding to the other Party’ puts South Sudan

         at a disadvantage since it has more claims to the non-oil arrears than the

          Sudan.

 

H-  Agreement to Facilitate Payment of Post-Service Benefits

 1.      The Republic of Sudan, as the continuing state, has acknowledged its duty and agreed to pay all post-service benefits to all South Sudanese who were working for the government of the Sudan.

2.      A Joint Ministerial Committee on Pensions shall be established within thirty (30) days of the signing of this Agreement with “primary responsibility for discussing and reaching agreement on all issues related to pensions administration of relevance to the two States.”

3.      Another Joint Technical Committee on Pensions shall be established within the same period.

 

The resolution of the vital matter of post-service benefits is overdue.  This is a

        framework agreement which, it is hoped, will solve the problems of the many

        South Sudanese who have not got their post-service benefits up to now. Like

        the other agreements, the details of the actual solution of the problem are left

        to committees.

 I-      Agreement on Security Arrangements

 1.      The Parties renewed “their commitment to the cessation of harbouring of, or support to rebel groups against the other State.”

2.      The Parties renewed “their commitment to immediately cease all hostile propaganda and inflammatory statements in the media”.

3.      The Parties reiterated that they “shall immediately issue instructions to their forces to withdraw unconditionally to their side of the border.”

4.      The ’14 mile’ area shall be completely demilitarized and “the status quo of the joint tribal mechanisms for the resolution of disputes” maintained.

5.      The ‘Safe Demilitarized Border Zone’ is agreed and shall be immediately operationalized.

6.      The Parties agree to immediately open the 10 agreed border-crossing corridors. The modalities of this process shall be agreed by the Joint Political Security Mechanism.

 It is clear from this Agreement that:

 (i)-  The SPLA is to withdraw from ’14 mile’ area. As is well known, Sudan has

       insisted on rejecting the map for the demilitarized zone that puts ’14 mile’ on

       the side of South Sudan. It has now got its way.  This seems to be the move

       that opened the way for the agreement on the ‘Safe Demilitarized Border

       Zone’.

(ii)- The government of South Sudan has consistently denied harbouring and

        supporting rebels of the Sudan in its territory. Now, not only has it admitted

        that, but has agreed to cease harbouring of and support to these rebels.

(iii)- The insistence of the government of the Sudan for a security agreement before

        signing other agreements has now paid off.

 Conclusion

 The analysis of the agreements signed in Addis Ababa on the 27th of September 2012, between the governments of Sudan and South Sudan has shown that for the first time the issues have been dealt with one-by-one on their merits rather than sticking to the condition always imposed by the SPLM side that no agreement would be signed without the conclusion of all the outstanding issues, especially the one relating to Abyei area. Now this agreement has been signed without agreement on the disputed and claimed border areas; conclusion of the status of Abyei area; and finalizing the other matters on which agreement has been reached. The remaining points in these agreements, or what the Parties call ’details’, were left to be settled by joint committees to be formed at a later date.  These agreements were made possible by concessions made by the delegation of South Sudan on oil fees, non-oil arrears, cessation of support to Sudan’s rebels, and demilitarization of ’14 mile’ area.

 The big concessions were in the areas of oil fees and security arrangements. The correct reading of this situation is that the South Sudanese side was desperate to get the oil flowing again and this was exploited by the Sudanese side to push for concessions in the security area the conclusion of which has always been its condition for signing any agreement with South Sudan. The celebrations in Khartoum for the signing of these agreements attest to that conclusion.

 The SPLM-DC pointed out in January this year, when the oil production was shut down, that the decision to do so was a hurried one that did not study the consequences of the shut-down, nor put forward alternative sources of revenue to replace the 98% dependence of the national budget on oil. Exactly, as the World Bank predicted, the economic crunch which followed that shut-down is now biting the government in Juba. Hence, their hurry to get the oil on stream again. Therefore, the agreements in Addis Ababa were meant to serve the short-term interest of the SPLM and its stalwarts who are running out of money as a result of closing down oil production facilities. What goes round comes round.

South Sudan has little to gain from these agreements, except may be in improved security if the two governments of Sudan and South Sudan will live up to their commitments to live as two good independent and sovereign neighbouring states in peace and economic interdependence.

The Nuer Youth leadership in Juba is deeply troubled by the events which have been taking place in the city since October the 11th, 2012, the day Maj. Gen. Simon Gatwec Duel was arrested at work in Bilpam Headquarters. We thought that his arrest was something related to administrative issues until we read the press release of Jieng Community Association in Juba which categorically stated that Maj. Gen. Simon Gatwec was incarcerated due to his support to Nuer Prophet Dak Kueth and Murle rebel commander, David Yau Yau. The legal department of Nuer Youth Association began to investigate the real cause of his arrest despite claims of Jieng Community Association and discovered that he was detained by Military Intelligence (MI) that was ordered by the Commander in Chief of the SPLA army, 1st Lt. Gen. Salva Kiir Mayardit. The chief of MI told the leadership of Nuer youth that Maj. Gen. Simon Gatwec was detained “because he was working with other politicians to stage a coup against the leadership of President Salva Kiir”.
The Nuer Youth dismissed the claims of MI because Juba has been rocked with rumors of coups since last year. It should be noted that there is no month that could pass by without a rumor of a coup in Juba. Last year, it was rumored that Deputy Minister of Defense, Dr. Majak Agot, was planning a coup to topple President Kiir. That rumor died without any incident. In July this year it was also rumored that Presidential advisor on Human Rights, Madam Rebecca Nyandeng Garang met with some Bor officers and appointed Maj. Gen. Mac Paul to stage a coup against President Kiir. That rumor was even published in the media. However, it was discovered that Rebecca Nyandeng didn’t plan any coup and was being blackmailed in the media. Moreover, when the son of late Dr. John Garang de Mabior, Col. Mabior Garang de Mabior, gave an interview to McClatchy newspaper in Nairobi expressing his dismay on the leadership direction in South Sudan, it was also rumored in Juba that he was planning a coup.
When the agents of Military Intelligence said that Maj. Gen. Simon Gatwec Duel was detained because of allegation of a coup, everybody dismissed it as another rumor mill in Juba spewing nonsensical charges against a respectable officer like Simon Gatwec. However, the Nuer Youth is shocked today, Tuesday, October, 16, when President Salva Kiir confirmed in the meeting with officers at Bilpam Headquarters that Maj. Gen. Simon Gatwec Duel was arrested because he and unnamed politicians planned to stage a coup against his government. The President said that Maj. Gen. Simon Gatwec would be taken to court and if found innocent he would be released. The statement of the President put to rest the doubts of all those who were dismissing the allegations of a coup as the usual joke and began to ask serious questions.
Sources within the military intelligence revealed that the coup leaders are Deputy Minister of Defense, Dr. Majak Agot and Hon. Dr. Riek Gai Kok, a member of South Sudan Legislative Assembly representing Akobo County of Jonglei State. However, when meeting military officers at Bilpam Headquarters on October, 16, President Kiir praised Dr. Majak Agot and Lt. Gen. James Hoth for foiling the coup while he was in Uganda. But the revelations coming from MI alleged that Dr. Majak Agot was in fact the leader of the coup who recruited Maj. Gen. Simon Gatwec. The question every reasonable South Sudanese is asking is: If Maj. Gen. Simon Gatwec was part of the coup, where are the other officers? Where are the politicians who organized the coup? Why didn’t President Kiir arrest Majak Agot and Dr. Riek Gai Kok who are named by MI as leaders of the coup?
According to sources within the MI, Dr. Majak Agot was the one who gave President Kiir the list of 31 officers ranging from Brig. Generals to Maj. Generals as officers who planned to stage a coup. It is said that Majak      Agot denied being part of the coup and told Kiir that “the Nuer are the ones planning to overthrow Dinka government”. The funny part of the allegation of a coup is that the politicians who organized the officers have not been arrested and only one man is targeted. That begs the question and the Nuer Youth are having difficulty believing President Kiir’s version of events because it would be the first time on earth that one Maj. General could stage a coup alone without politicians backing him up. If the rumors which have been circulating since last year are being believed by the President, the question is: Why wouldn’t the President believe the previous rumors linking Majak Agot, Rebecca Garang and Col. Mabior Garang to the conspiracy of staging a coup against the government? Col. Mabior Garang is on record calling for removal of President Kiir when he gave interview to McClatchy newspaper. He never denied his interview but qualified it recently by saying that he was calling for “peaceful uprising against the government”. After the events of Tunisia, people know that the line between popular uprising and a coup is indistinguishable. Yet, President Kiir did not detain Col. Mabior Garang when he returned to Juba on October, 9th.
After a thorough scientific investigation, the Nuer Youth discovered that Maj. Gen. Simon Gatwec Duel was not incarcerated because of allegation of a coup since all the facts revealed that the allegation of a coup is a lie. We have discovered that President Kiir wanted to implement a policy of purging the Nuer officers out of the SPLA army. This policy was delayed when Paulino Matip was alive because he was against it. After his death, President Kiir and his Dinka elites revived the policy and identified thirty five Nuer officers to be removed from the army so that the Dinka would firmly control the South. The allegation of the coup is a ploy to cover up the real plan. Using coup as the reason to detain Maj. Gen. Simon Gatwec Duel is a tactic to detain all the Nuer officers one by one because official retirement of all Nuer officers at once may raise suspicions. Salva Kiir himself said in August in a meeting with officers in Bilpam that he would be retiring military officers starting from Brig. General upward. He didn’t implement that plan right away because he was advised that it would create tribal tension.
The Nuer Youth would seriously advise President Kiir and the Dinka community at large that the politics of tribal domination and nation-building are antithetical. The same tactics being employed by President Kiir in targeting the Nuer were used by the Hutus rights after the independence of Rwanda in 1961 and led to first Rwanda genocide. After the resistance launched by the Tutsis in defending themselves from Hutus dominated government, the Hutus political elites decided eventually that the only solution was to exterminate Tutsis on earth and that policy culminated into the second genocide in 1994.
However, South Sudan is a multiethnic society and the Nuer community is a heroic community that could not be dominated. For the last three hundred years, Dinka never defeated the Nuer in any battle. In 19th C, the Nuer conquered Dinka lands and assimilated 30% of Dinka. In the 20th C, the Nuer is the only tribe in Africa which fought the British for thirty years with spears. The Nuer were the first to bring down British plane with a spear—an experienced which shocked the British empire up to now.
When the Comprehensive Peace Agreement (CPA) was signed, the Nuer community came to conclusion that past conflicts with Dinka should be brought to an end because nation-building demands that South Sudanese people transcend tribal politics in order to forge a viable nation state. When Paulino Matip signed Juba Declaration on January 9, 2006, the Nuer community applauded the spirit of cooperation between him and President Salva Kiir. Despite the glaring mistreatment of Nuer for the last six years, our community endured humiliations in the name of South Sudan. Maj. Gen. Bol Kong in 2006 was the first SPLA officer that fought his own people of Lou Nuer to carry out the government disarmament program in the name of South Sudan. Today, the Jieng Community called him Nyagat (fifth columnist) after defending South Sudan from external threats because he is a Nuer. When war broke out between the North and the South in March this year, it was Maj. Gen. Bol Kong and other Nuer officers who heroically defended South Sudan border. More than 80% of SPLA forces along the North-South border are Nuer. More than five thousands SPLA soldiers killed in Heglig and Jaw battles were Nuer.
It has become a habit that when there is a war between the North and the South, the first people President Kiir relies on are Nuer. In 2008 fighting between the SPLA and SAF in Abyei, it was Maj. Gen. Peter Gatdet who heroically defeated the SAF. After the end of the fighting, he was called Nyagat in Juba and denied medical benefits to go for treatment in Nairobi after a long fighting in Abyei. That was one of the reasons he left the government in 2011 and formed a rebel movement.
After Peter Gatdet formed South Sudan Liberation Army (SSLA) in March, 2011 to fight the government of South Sudan, it was Maj. Gen. Simon Gatwec Duel and Maj. Gen. Bol Kong who convinced him to abandon rebellion. Indeed Peter Gatdet signed an agreement with the government and he is now the deputy commander disarming civilians in Jonglei. Had it not been for Nuer officers like Bol Kong and Simon Gatwec Duel who rejected rebellion, South Sudan could not have been independent last year. Today, all their work to save the South is thrown to dustbin because they are Nuer and the only reward they get is to label them asNyagats.
The Nuer Youth are aware that President Kiir wants to endanger the very survival of South Sudan as a viable state after achieving independence last year. However, the Nuer community refused to be part of the failure of the South and stood firmly in safeguarding the territorial integrity of South Sudan from external threats. The Nuer who died in the border war with the North died in defending the honor of South Sudan. Maj. Gen. Simon Gatwec Duel has more than five family members killed in action defending South Sudan.
When Maj. Gen. Gabriel Tang, Maj. Gen. Simon Mabor Dhol and Brig. Gen. Gatwec Joak were illegally detained last April with orders of President Salva Kiir, it was Maj. Gen Simon Gatwec Duel and Maj. Gen. Bol Kong who calmed down the Nuer Youth. Up to now, Gabriel Tang and his officers have never received justice let alone being informed of the reasons for their detention. The South Sudan constitution states that any accused should be accorded due process in a short time possible. However, all the constitutional stipulations have been ignored because the accused individuals are Nuer. When Maj. Gen. Marial Nuor, a Dinka, was accused of raping girls and murdering an engineer in Juba, he was detained for few days but was produced before a judge. He was allowed to have a legal counsel who argued his case and today he is out of prison after being arrested for only two weeks. Up to now, the government dropped the case against him although the UN documented his abuse of girls at night in the city. The reason for his release is because he is a Dinka.
Since his arrest on October, 11, 2012, Maj. Gen. Simon Gatwec Duel has been denied food for five days and his wife has been prevented from visiting him. He has never been accorded due process as stipulated in the Interim Constitution and was not allowed to retain a legal counsel let alone being told the reasons for his detention. While President Kiir is talking about justice, the only people who receive justice in South Sudan are Dinka, not Nuer because since April, 2011, Gabriel Tang, Mabor Dhol and Gatwec Joak have never received justice.
The Nuer Youth are calling on President Kiir to release Maj. Gen. Simon Gatwec Duel as soon as possible without conditions from our community. The patience of Nuer community is running thin and President Kiir should not wish to return the South to dark days of 1990s when William Nyoun and Bol Kong defeated him at Magir with only seven hundred fighters while he was commanding fifteen thousands. Nuer’s fighting spirit is unquestionable; however, the Nuer community resolved that ethnic fighting would destroy South Sudan and return our people to abject poverty and suffering. The number of Nuer and Dinka who died as a result of factional wars in 1990s far exceeds the number killed by the Sudan Armed Forces in the course of liberation struggle.
When the Nuer Youth convened a meeting last year at Nyakuron Cultural Center, Maj. Gen. Bol Kong told the Nuer Youth that South Sudan should abandon violence and adopt the path of peace as the only way to achieve political power. Bol Kong advised South Sudan politicians to use ballot box as the only way to bring political change in South Sudan. Today, the Jieng Community labeled him asNyagat after fighting his own people in 2006 to carry out government’s disarmament policy.
The Nuer Youth would not release another press release again to advise President Kiir to abandon destructive tribal politics. Instead the President should consult history and release Maj. Gen. Simon Gatwec Duel immediately. We have realized that Nuer’s pacifism is being seen by Dinka community as a weakness and some members of Kiir’s elites have begun making presentations that “the Nuer are defeated”.  This release is our last advice to the President because our patience is running out. The responsibility to keep peace in South Sudan is a responsibility of all people including Dinka community. It is the interest of every South Sudanese to see that peace reigns supreme in South Sudan. But if communities that have realized the importance of peace are being labeled as “cowards” or “being defeated”, the future of South Sudan is bleak.
As youth, we believe that peaceful South Sudan is our priority and will benefit us more than President Kiir who is getting old. The future of South Sudan belongs to the youth and we are the last sector of Nuer community to see South Sudan on fire. However, the Nuer community has inalienable right to defend itself if President Kiir is pursuing policies of domination and extermination. If President Kiir is interested to impose war on Nuer although they don’t want it, it is instinct of every human being to defend themselves when attacked. The right of self-defense is a right recognized internationally. But our hearts break to see that the President of a newly independent country wants to return the Nuer and Dinka to 1990s factional wars.
We call upon peace-loving Dinka brothers to advise the President that the Nuer—Dinka war is the end of South Sudan. Such a war should not be promoted by anybody be it President Kiir or the youth of South Sudan who would be the losers. The future of South Sudan belongs to the youth and the next generation needs to see a culture of peace being promoted by our leaders. But the policies of President Kiir will return us to factional war of 1990s when he and Maj. Gen. Bol Kong fought for a month in Equatoria and wasted more than thousand lives of the people of South Sudan who should be now contributing to our country’s development. The Nuer are not cowards but our community resolved in 2006 that tribal wars would not take our country forward and there is a need to stay away from tribal tendencies which nearly destroyed South Sudan liberation movement in 1990s.

Coup plotters will be isolated internationally if succeeded – South Sudan’s Kiir

October 16, 2012 (JUBA) – South Sudan’s president Salva Kiir Mayardit has warned the army from being carried away by rumours of coup attempts, saying any leadership that will overthrow his regime militarily will not be recognized by the international community.

The commander-in-chief of the South Sudan army, the Sudan People’s Liberation Army (SPLA) delivered the warning on Tuesday at the army’s general headquarters in Bilpam in his second meeting with the army since he returned from Uganda after the rumours of a coup plot.

The Tuesday meeting included all SPLA officers residing in Juba from junior officers to the chief of general staff. Kiir on his way to Bilpam was guarded with huge heavily armed presidential guards packed in several army vehicles including an ambulant.

There were serious rumours of a coup plot by unknown army officers, but Kiir told thousands of soldiers during the meeting that even if the coup plotters succeeded they would face difficulty getting recognition by the international community.

He called on anybody who wants to lead the country to ascend to power through democratic processes.

He narrated that the news about the coup attempt reached him while he was on mission in the Ugandan capital, Kampala, with both the minister of defence, John Kong Nyuon and the Chief of General Staff, James Hoth Mai, adding that it was the deputy minister of defence and veterans affaires, Majak Agoot who was in charge of the army at the time.

The Vice President, Riek Machar, was also abroad in the United States where he was delegated to attend to meetings of the United Nations.

Kiir told the army that the reports that reached him implicated Maj. General Simon Gatwec Dual as having links with the rebels of David Yauyau in Jonglei state. The general who is in prison, he said, will be investigated further to face the law if found guilty or acquitted if not found guilty.

An intellectual from the Lou-Nuer community who asked to remain anonymous told Sudan Tribune that Maj. Gen. Gatwec, who was the deputy director for production at Bilpam, was used as a scapegoat to try to explain “the unknown” to the public, denying that he did not have any link with rebels nor did he involve in any coup plot.

Rumours about a coup attempts have been talked of several times suspecting different groups, particularly from Jonglei state.

The army, he added, should be vigilant and cooperate with the intelligence to communicate any strange moves, but warned them not to listen to rumours any more.

On discontent against the Addis Ababa cooperation agreement with Sudan, Kiir said he did not intent to give away Mile 14 to Sudan, but that was a temporary security arrangement to create a buffer zone between the two armies of Sudan and South Sudan.

Citizens from Aweil in Northern Bhar el Ghazal state demonstrated in Juba on Monday against the agreement, prompting the police to fire live rounds to disperse them.

The demonstrators later on converged in front of the national parliament holding placards and banners and chanting “down, down, Salva Kiir.”

Kiir told the army that even though he was insulted by the demonstrators he did not order the police to fire live bullets to disperse them.

He challenged those who were against the Mile 14 arrangement as returnees from the Diaspora who worked to instigate the situation.

Meanwhile the national parliament endorsed the Addis Ababa cooperation agreement on Tuesday as requested by President Salva Kiir during his briefing to the lawmakers on Monday.

SPLM-DC: Position of the Leader of Minority on The Cooperation Agreement

Position of the Leader of Minority on The Cooperation Agreement between The Republic of South Sudan and The Republic of Sudan signed in Addis Ababa, 27thSeptember 2012.

According to Article 71.(2) b of the Transitional Constitution, 2011 of The Republic of South Sudan read together with section 9 (3) of the conduct of business Regulations of the National Legislature, 2011, Please allow me to present to this August House, our Reply to the Speech of H.E. The President on The Cooperation Agreement between The Republic of South Sudan and The Republic of Sudan.

Rt.Hon. Speaker Sir,

Let me take this opportunity to thank you for giving me this chance and to thank H.E the President of the Republic of South Sudan for this bole decision they took in signing The Cooperation Agreement in Addis Ababa.

The two parties specifically state that “The people of South Sudan and Sudan share a long and rich common heritage and bound by immutable facts of geography to remain interdependent neighbours” and affirm their “determination to work in close partnership, to finalize all outstanding details remaining in relation to the Agreement they have reached, relevant to the implementation of the Agreement thus finalize.” Here eight Agreements are listed and published. The details will be finalized through joint ministerial and technical committees to be formed by the two countries.

The parties have agreed on the outstanding issues to be negotiated by the parties is the disputed and claimed borders areas. And the problem of the Abyei area is now left in the hands of the AUHIP.

This Cooperation Agreement signed between the governments of South Sudan and Sudan is a step forward to solving the other issues of disagreement if the two governments are committed to the

implementation of the Agreement. It will build confidence between the former warring nations and will promote peaceful co-existence.Rt. Hon. Speaker,

Hon. Members,

We would like raise the following observations:-

5-    Sight -seeing by the mediators and the negotiating teams to the claimed and disputed areas is very essential before putting it to the arbitration.

6-    The government of South Sudan should still engage the AU to speed up the problem of Abyei so that they can decide their own fate.

Hon. Members,

1-With the Signing of the Cooperation agreement, we call upon the government of the Republic of South Sudan and The Republic of Sudan to have a political will and commitment for the implementation of the agreement.

2-The two governments should leave supporting the arms groups fighting the proxy war undermining one another and commit themselves to dialogue with rebels for peaceful co-existence.

3-The government of South Sudan should now manage the coming oil revenue well and with transparency and accountability so that corruption will be minimized.

4-The government should scale down itself to a lean government in order to have effective, manageable and efficient good governance both in the states and national government.

As we pointed out in January this year, when the oil production was shut down, that the decision to do so was a hurried one that did not study the consequences of the shut-down, nor put forward alternative sources of revenue to replace the 98% dependence of the national budget on oil. Exactly, the economic crunch which followed that shutdown is now biting the government which forced it to hurry to get oil stream again and the pressure from the international community as well.

Therefore, we call upon the SPLM led government of The Republic of South Sudan that there is a need to work together for the national issues and the national interest so that we will be able to face them for nation building. South Sudan is not an island of its own but it is a part of the International community and it must be abide by the principles of this the world family.
